Subject: **UPDATE** Cape Coral Police On-Scene of a Battery Investigation

Cape Coral Police have cleared the scene of the battery investigation on Avalon Drive. Upon interviewing the female victim, it was determined that she was indeed the victim of a misdemeanor battery and false imprisonment. The victim told police that she tried to exit the residence overnight but was prevented from doing so by the suspect, Dustin Bunting. Bunting also reportedly took a phone out of the victim's hands preventing her from calling police earlier in the night.

On-duty patrol officers surrounded the home and attempted to negotiate the safe surrender of Bunting who was refusing to exit the home. Bunting's grandmother, the owner of the home, refused to allow police to enter to take Bunting into custody. This, coupled with Bunting's refusal to exit, forced police to re-evaluate the situation.

The victim was safe and her injuries were very minor, the criminal charges were isolated to one victim and Bunting was determined not to be a threat to the community as a whole. There were no reports of weapons and Bunting had made no threats to hurt himself.

The commanders at the scene made the decision to pull back and clear the area. Detectives will follow up later with the open charges against Bunting.

"When all of the factors were weighed, we felt that this was the best course of action both in terms of safety and fiscal responsibility. The suspect will not escape justice, he will have to answer to the charges. We have to be cognizant of the allocation of our resources when evaluated against the circumstances surrounding particular crimes/incidents. This is the responsibility of our front line supervisors and they make these decisions on a daily basis. The takeaway here for the citizens of Cape Coral, is that they have a well trained group of men and women who know when to advance and when to deescalate in a situation. Subject: Cape Coral Police On-Scene of a Battery Investigation

At 6:30 this morning, Cape Coral Police were called to the scene of an unknown disturbance at a residence in the 400 Block of Avalon Drive.

Preliminary investigation reveals that an adult female was visiting a male acquaintance at 432 Avalon Drive last night where the two were consuming alcohol. During the night, an argument ensued and became a physical altercation between the two.

The female is out of the home now and with police; the male subject is inside of his residence alone at this time.

As of 8:15am, Police Personnel are attempting to have the male come outside.

There are some media outlets on scene. The area for staging if you chose to respond is the corner of Tower Drive and Avalon Drive.
