(June 29, 2015)- A Cape Coral man was arrested Friday afternoon on charges of Animal Cruelty, Criminal Mischief, and Grand Theft.
Just before 3:00 PM on Friday afternoon, Cape Coral Police responded to 1409 NW 7th Place on a disturbance call.
Investigation revealed that two roommates got into a heated verbal argument. During the argument, one of the roommates, identified as 20 year old Paolo Melendez, took a cell phone from his roommate's hand and smashed it on the floor, causing damage. He also caused injury to his roommate's dog by holding his roommate’s Pit Bull by its choke collar and allowing his Pit Bull to attack it, causing numerous punctures to its legs.
Melendez committed the offense of Grand Theft since he knowingly and unlawfully obtained the iPhone 5C, belonging to his roommate, by removing it from her hand. Melendez did so with the intent to temporarily deprive his roommate of her right to the phone or any benefit from it. Melendez refused to return the phone and hid it from his roommate while they were inside the residence and involved in a verbal argument.
Melendez committed the offense of Criminal mischief since while in possession of the phone, Melendez intentionally damaged the iPhone 5C, belonging to his roommate, by cracking the screen. The damage was done willfully and maliciously when he threw the phone onto the floor (which is concrete) and the screen shattered.
Melendez committed the offense of Cruelty to Animals since Officers determined that Paolo Melendez, while in control of 8 year old pit bull "Mike," intentionally exposed "Mike" to excessive and repeated infliction of unnecessary pain or suffering by allowing his 2 year old Pit Bull "Sky" to repeatedly bite Mike's front legs while pulling his choker chain up, causing Mike's front legs to be lifted off the ground, leaving him defenseless.
Melendez was placed under arrest and transported to Lee County Jail.
