(November 17, 2016)- Montaigu Moselle, the driver in a July 2015 crash that claimed two lives, was found guilty yesterday on two counts of DUI manslaughter.
The trial lasted three days, and after only 45 minutes of deliberation, the jury found the defendant guilty of all charges (two counts of DUI manslaughter). Moselle's actions caused the deaths of Paul Ortiz, 84, and Joan Ortiz, 78, both of Salem, SC.
The defendant was immediately remanded into custody and a sentencing hearing has been set for January 17, 2017, where he is facing up to 30 years in prison.

DRIVER 1 INJURIES: Moselle suffered serious injuries in the traffic crash (transported to Lee Memorial Hospital).
VEHICLE 2: 2015 grey Chevrolet Impala car, Florida tag# BNZZ09.
DRIVER 2: Paul WE. Ortiz, W/M, 7-8-59
DRIVER 2 INJURIES: Ortiz suffered minor injuries (transported to Lee Memorial Hospital).
PASSENGER 1: Kathleen Ortiz, W/F, 3-19-58, 5 Eisenhower Drive, Woodridge, NJ 07075.
PASSENGER 1 INJURIES: Ortiz suffered minor injuries (transported to Lee Memorial Hospital).
PASSENGER 2: Joan Ortiz, W/F, 7-19-36, 38 Channel Lane, Salem, SC 29676.

Vehicle 1 was East on Veterans Memorial Parkway approaching Skyline Boulevard in the outside North turn lane. Vehicle 1 came to a stop. Vehicle 2 was West on Veterans Memorial Parkway in the inside straight lane approaching Skyline Boulevard. According to several witnesses, East and West traffic had a solid green light for straight traffic, and solid red turn arrows for the North and South turn lanes.
According to witnesses, Vehicle 1 entered into the intersection to turn North and drove directly into the path of Vehicle 2 that was traveling at normal speed (approximately 50 mph). Vehicle 1 struck Vehicle 2 head on. Vehicle 2 was forced to the Northwest and came to rest against the curb, facing Northwest. Vehicle 2 was forced to the West and came to rest in the median on the West side of Skyline Boulevard, still on Veterans Memorial Parkway.
Officers arrived on scene immediately and located the driver of Vehicle 1 in the driver’s seat. The driver of Vehicle 1 suffered multiple serious injuries and was trauma alerted by ambulance to Lee Memorial Hospital. The two rear passengers of Vehicle 2 suffered life threatening injuries and were transported to Lee Memorial Hospital. The driver and front passenger of Vehicle 2 suffered minor injuries and were transported to Lee Memorial Hospital by ambulance.
The rear passengers of vehicle 2 are currently listed in critical condition at Lee Memorial Hospital. This traffic crash IS ALCOHOL related. The next of kin HAS BEEN notified. This case is pending further criminal investigation.
****The driver of Vehicle 1 had a medical blood alcohol level of 0.214 at the hospital. A post Miranda confession was obtained from the driver at the hospital, and also on video/audio recording by use of the department Body Worn Camera system. It was further learned that ALL FOUR occupants from Vehicle 2 had just flown in recently for the main purpose of attending the city of Cape Coral Red, White, and Boom festival. Passenger #2 is now a quadriplegic due to her injuries suffered in the traffic crash. Passenger #3 is in critical condition and not doing too well.****
