(February 26, 2018)-  The Cape Coral Police Department made three DUI arrests between February 23-26, 2018. Below is the information on these arrests:

ARRESTED: Edgar Diaz (W/M, DOB: 11/05/1988, of 

1534 NE 4th Terrace, Cape Coral

 

CHARGES: DUI, Poss. of Cont. Substance w/o Prescription, Poss. cannabis under 20 grams
CR#:18-003799

Units responded to a reckless driving complaint.  The complainant reported that the vehicle was doing doughnuts in a vacant lot.  Diaz was located and was sitting in the driver’s seat with his genitalia hanging out of his shorts and drool coming from his mouth.  Diaz did not pass Field Sobriety Evaluations.  BAC was .154 and .146.  The vehicle inventory revealed ten (10) Oxycodone Hydrochloride pills and 3.3 grams of marijuana.

ARRESTED: Blake Patrick Bening, W/M, DOB: 10/28/1999, of 512 Periwinkle Way, Sanibel Island

CHARGES: DUI, DUI Property Damage,  Poss. cannabis under 20 grams, Poss. of Cont. Substance
CR#: 18-003711

During a traffic crash investigation, Bening showed clues of impairment that lead into a DUI investigation.  Breath results were .000.  Mobile Enforcement Team Corporal Esterle was on duty and responded to conduct the Drug Recognition Evaluation.

ARRESTED: Daniel Lee Smith, W/M 11/21/1995, 2614 SW 21st Avenue, Cape Coral

 

CHARGES: DUI, Poss. Of Controlled Substance, Poss. Of Drug Paraphernalia

A Traffic Stop for multiple red-light violations revealed that Smith was impaired.  Breath .24 / .23.  K9 Oz also alerted on the vehicle which led to the discovery of marijuana wax.

Carmen Santora, W/M, DOB: 02/23/1967, of 3620 SW 3rd Avenue, Cape Coral

CHARGES: DUI, DUI with Property Damage
CR#: 18-003680

Officers responded to a hit and run traffic crash at 3620 SW 3rd Avenue. The victim stated that her boyfriend, Carmen Santora, was backing out of the garage and struck her vehicle which was parked in the driveway. Santora then pulled around the vehicle and left the area. The victim stated that Santora had been drinking alcohol. While officers were taking the report, they saw Santora drive back to the residence. Santora appeared intoxicated and had a hard time standing up. A DUI investigation ensued, and Santora could not complete the field sobriety tasks. Officers arrested Santora for DUI and DUI with Property Damage.
