(February 11, 2019)- On October 25th, 2018, at around 8:28 AM, Cape Coral Police responded to a call for service in reference to a two-vehicle traffic crash on Diplomat Pkwy W at the intersection with Nelson Rd.
Major Crash Investigator Officer Danny Gray responded and took over the investigation. Drug Recognition Expert (DRE) Officer H. Esterle responded and completed a Drug Influence Evaluation on the driver of the at-fault vehicle, Brett Dwight Pelham (W/M, DOB: 05/02/2002, 753 SW 5th Ter). A blood sample was obtained from Pelham which later showed positive for THC and metabolites.

Probable cause was established based on the totality of the investigation that on October 25, 2018, around 8:28 AM, Brett Pelham was the driver of a 1999 Toyota Tacoma pickup truck, and that Pelham operated the vehicle in a reckless manner likely to cause the death of or great bodily harm to another person by traveling at nearly twice the posted 45-MPH speed limit and failing to stop at a posted stop sign as he drove west on Diplomat Parkway W, and that his actions directly contributed to the death of another, (Jill Marie Mandeville, W/F, DOB: 06/21/1985), all in violation of the laws against Vehicular Homicide. Probable cause was also established to believe that Brett Pelham was driving the motor vehicle while under the influence of a controlled substance which directly contributed to a traffic crash that resulted in a fatality in violation of the laws against Driving Under the Influence Manslaughter. Additionally, while operating a motor vehicle in a reckless and negligent manner Brett Pelham did not possess a valid driver’s license and caused a fatality in violation of the laws against Operating a Motor Vehicle Carelessly or Negligently Causing Death Without Having a Driver’s License.
On February 8, 2019, Major Crash Investigator Officer D. Gray responded to Pelham's home address as part of a follow-up investigation. Officer D. Gray located Pelham walking in the 500-BLK of SW 7th PL and arrested him without incident. At the time of arrest, Pelham was in possession of a Juul Vape e-cigarette which contained THC oil.
Pelham was charged with DUI Manslaughter, Vehicular Homicide, Driving Without a License Causing Death, and Possession of a Controlled Substance.
Pelham was transferred to the Juvenile Assessment Center.
