Passenger in Fatal Crash on October 25, 2018 Sentenced on August 12, 2019

On February 13, 2019, Morgan Skau turned herself in at the Cape Coral Police Department due to being charged with permitting an unauthorized operator to drive (Fla. Stat. 322.26). The Traffic Homicide Investigation revealed that, Morgan Skau, who was a passenger in Vehicle 1 during a traffic crash that resulted in fatal injuries to another driver, knowingly allowed an unlicensed driver, Brett Pelham, to drive her pickup truck. Morgan Skau was turned over to the Juvenile Assessment Center at the Lee County Jail.

On August 5, 2019, Defendant Morgan Skau entered an open plea in court. Morgan Skau was adjudicated guilty, however, Judge Swett postponed sentencing until August 12, 2019. On August 12, 2019, Judge Swett sentenced Morgan Skau as follows:

1 year suspension of driver's license

6 months probation

50 hours of community service for every month of probation

6 PM to 6 AM curfew

Electronic monitoring

Substance abuse counseling

Aggressive driving course

Lee Memorial Hospital Trauma course

Victim impact panel

$500 fine, plus court costs

SYNOPSIS:

 Vehicle 1 was traveling west on Diplomat Pkwy W, approaching the intersection with Nelson Rd N, in the outside lane. Vehicle 2 was traveling south on Nelson Rd N, approaching the intersection with Diplomat Pkwy W, and in the inside lane and at a high speed. Vehicle 2 stopped at the stop sign and then began to proceed south across the intersection. Vehicle 1 failed to stop at the stop sign and skidded into the intersection. The front of Vehicle 1 collided with the driver’s door of Vehicle 2. The impact with Vehicle 1 forced Vehicle 2 to the west for approximately 90 feet where it came to final rest facing to the southwest across both westbound lanes of Diplomat Pkwy. After the impact, Vehicle 1 continued traveling to the west along Diplomat Pkwy while rotating nearly 180 degrees. Vehicle 1 came to final rest facing to the southeast in the west outside lane of Diplomat Pkwy.

 The driver of Vehicle 2 suffered fatal injuries in the crash. The driver and passengers of Vehicle 1 suffered serious but not life-threatening injuries, and all were transported by ambulance to Lee Memorial Hospital. None of the occupants in Vehicle 1 were wearing seatbelts. The driver of Vehicle 1 does not have a driver’s license. The investigation is on-going and charges are pending.

(August 12, 2019) - The following are the Cape Coral Police Department’s DUI arrests between August 2nd and August 11th, 2019. This edition contains SIX persons more than twice the legal limit, of which two were three times the limit and one four times; stops made for speeding and red light violations; an arrestee who attempted to headbutt an officer; and two who were involved in a traffic crash with each other. These arrests do NOT include the four arrested during the August 10th High Visibility Enforcement operation; the news release for those arrests can be found here.

The easiest way to not get a DUI is to NOT drive impaired. If you are going out to partake in adult beverages, designate a sober driver or utilize an alternate form of transportation: Uber, Lyft, taxi, bus, etc. Don’t take the chance of ruining a life, including your own.

ARRESTED: Paul Douglas Kalka, W/M, DOB: 4-7-70, of 1865 Monte Vista Street, Fort Myers FL.

CHARGES: Driving Under the Influence

A CCPD Patrol officer responded to a report of a disturbance at the 600 block of Del Prado Boulevard South, where he made contact with Kalka. It was discovered that Kalka had just driven his vehicle to the location and was still sitting inside the running vehicle. The officer noticed signs of impairment and began a DUI investigation. Kalka performed poorly on field sobriety exercises and was arrested. BAC%: .138 / .135

ARRESTED: Cody Ray Wilson, W/M, DOB: 11-15-73, of 2013 Hancock Bridge Parkway, Cape Coral FL.

CHARGES: Driving Under the Influence With BAC% Over .15%

A CCPD Patrol officer stopped Wilson for a red light violation, which led into a DUI investigation. Wilson performed poorly on field sobriety exercises and was arrested. BAC%: .189 / .184

ARRESTED: Jonathan Junito Garcia, W/M, DOB: 2-5-91, of 305 NE 23rd Place, Cape Coral FL.

CHARGES: Driving Under the Influence, Violation of Probation

A CCPD Patrol officer stopped Garcia at the 700 block of Del Prado Boulevard North for an obscured tag and reckless driving, which led to a DUI investigation. Garcia refused both field sobriety exercises and a breath test.  It was found that Garcia had a 10pm curfew as a condition of his probation, with the stop occurring at 11pm. BAC%: Refused.

ARRESTED: Matthew Edward King, W/M, DOB: 4-1-83, of 2728 SW 4th Terrace, Cape Coral FL.

A CCPD Patrol officer investigated a traffic crash in which the at fault driver (King) was transported to Cape Coral Hospital. At the conclusion of the crash investigation, a DUI investigation took place. BAC% (Via medical blood draw): .332

ARRESTED: James Bryan Schundlemire, W/M, DOB: 10-4-92, of 2506 SW 38th Street, Cape Coral FL.

A CCPD Traffic officer stopped Schundlemire at the 1700 block of Beach Parkway West for an improper turn, which led to a DUI investigation and Schundlemire’s arrest. Post-arrest it was learned that his license was suspended multiple times. BAC%: .240 / .226

ARRESTED: Chase Bradley Carroll, W/M, DOB: 8-2-95, of 8383 Silverbirch Way, Lehigh Acres FL.

CHARGES: Driving Under the Influence With BAC% Over .15%

A CCPD Patrol officer responded to Sunsplash (400 Santa Barbara Boulevard South) for a request for officer call regarding heavily intoxicated subjects that just got kicked out of the waterpark. Carroll was seen falling down as he was exiting the park, then getting into an orange Jeep and driving the wrong way through the parking lot without his seat belt on. Carroll was stopped and showed signs of extreme impairment. Carroll performed very poorly on field sobriety exercises and was arrested for DUI. BAC%: .196 / .203

ARRESTED: Forest Leroy Brubaker III, W/M, DOB: 6-26-47, of 3703 SE 3rd Avenue, Cape Coral FL.

CHARGES: Driving Under the Influence, Refusal to Submit to Breath Test After Prior Refusal

Brubaker was located by a passerby at the 800 block of SE 47th Terrace passed out in his running vehicle.  Officers responded, and a DUI investigation ensued resulting in Brubaker’s arrest. BAC%: Refused.

ARRESTED: Manuel Jesus Delrio-Garcia, W/M, DOB: 7-13-65, of 3616 SW Santa Barbara Place, Cape Coral FL.

CHARGES: Driving Under the Influence With BAC% Over .15%, Driving With Suspended License (Habitual Traffic Offender)

A CCPD Patrol officer stopped Delrio-Garcia at the 2400 block of Santa Barbara Boulevard South for erratic driving, which led to a DUI Investigation. While in custody, Delrio-Garcia had a medical episode and was taken to the hospital by LCEMS for care. BAC%: .250

ARRESTED: Jason Quebbeman, W/M, DOB: 3-19-76, of 614 SE 46th Lane, Cape Coral FL.

CHARGES: Driving Under the Influence, Refusal to Submit to Breath Test After Prior Refusal, Simple Assault on LEO

A CCPD Patrol officer stopped Quebbeman for a stop sign violation at the intersection of Cape Coral Parkway and Waikiki Avenue. Upon contact, Quebbeman showed signs of impairment. Quebbeman refused both field sobriety exercises and a breath test, and was arrested for DUI based on the observations of the officers on scene. Dispatch confirmed that Quebbeman has had a prior refusal for breath, and he was charged accordingly. Once at the Lee County Jail, Quebbeman attempted to head-butt the officer in the sally port area of the jail, but narrowly missed. BAC%: Refused.

ARRESTED: Mark Jennings Davis, W/M, DOB: 1-7-63, of 474 NE 2nd Street, Cape Coral FL.

CHARGES: Driving Under the Influence, DUI Property Damage, Driving While License Suspended

Officers responded to a traffic crash involving Davis at the 400 block of NE 2nd Street. Upon contact with Davis, officers observed signs of impairment. Following the traffic crash investigation, a DUI investigation was conducted; Davis performed poorly on field sobriety exercises and was arrested for DUI. Dispatch confirmed that Davis had multiple suspensions on his driver’s license, which was revoked. BAC%: Refused.

ARRESTED: Brian Anthony Trimarco, W/M, DOB: 4-17-73, of 3113 W. Cortez Drive, Bradenton FL.

CHARGES: Driving Under the Influence, Driving While License Suspended, Resisting Without Violence

Officers responded to a reckless driver call of a white transit van (driven by Trimarco) all over the roadway on Del Prado Boulevard South, where it was narrowly missing other vehicles. According to the caller the white transit van was driving so erratically that other civilian vehicles were trying to stop the van themselves to prevent the driver (Trimarco) from killing someone. A CCPD Patrol officer located the vehicle and activated her emergency lights and sirens, but the vehicle would not stop. The white van was not eluding officers and traveling between 30 – 34 MPH, but was still all over the three lanes of travel and continuing south on Del Prado Boulevard. The vehicle was finally stopped at the 3900 block of Del Prado and contact was made with an inebriated Trimarco, who showed severe signs of impairment. Trimarco refused to perform any field sobriety exercises or a breath test, and was arrested. BAC%: Refused.

ARRESTED: Valeria Martinez-Lopez, W/F, DOB: 11-29-98, of 1409 SW 11th Street, Cape Coral FL.

CHARGES: Driving Under the Influence

Martinez-Lopez and Gomez (the below arrestee) were involved in a traffic crash with one another at the 2400 block of Del Prado Boulevard South. Upon contact, both subjects showed signs of impairment. Following the traffic crash investigation, both Martinez-Lopez and Gomez performed poorly on field sobriety exercises and both were arrested for DUI. Martinez-Lopez had a BAC%: .111 / .106

ARRESTED: Luis Enrique Gomez, W/M, DOB: 12-15-97, of 4323 SW Santa Barbara Place, Cape Coral FL.

CHARGES: Driving Under the Influence With BAC% Over .15%, DUI Property Damage

Gomez and Martinez-Lopez (the above arrestee) were involved in a traffic crash with one another at the 2400 block of Del Prado Boulevard South. Upon contact, both subjects showed signs of impairment. Following the traffic crash investigation, both Gomez and Martinez-Lopez performed poorly on field sobriety exercises and both were arrested for DUI. ARRESTED: Ashley Nicole Madrid, W/F, DOB: 5-7-86, of 4623 SW 8th Place, Cape Coral FL.

CHARGES: Driving Under the Influence

A CCPD Traffic officer stopped Madrid at the 200 block of Cape Coral Parkway West for speeding (67MPH in a 40MPH zone). Upon contact, Madrid showed signs of impairment. She performed poorly on field sobriety exercises and was arrested for DUI. BAC%: Refused.

(August 12, 2019) - On August 10th, 2019 the Cape Coral Police Department conducted a traffic saturation operation (wolfpack). The operation was a saturation patrol that was conducted citywide. Officers were focused on identifying and taking impaired drivers off the road as well as targeting areas with traffic issues that cause crashes. In addition to traffic violations, this operation yielded 4 arrests for driving under the influence. Below are the detailed results of this operation:

A CCPD Traffic officer initially observed Blanco Castellanos stopped in the roadway at the 3000 block of Del Prado Boulevard South, which presented a traffic safety concern. Upon the officer turning around, Blanco Castellanos started driving and upon being stopped for another violation he switched seats with his passenger (see below arrest). Indicators of impairment were present and Blanco Castellanos performed poorly on field sobriety exercises. He also had no driver’s license, resulting in his arrest. BAC%: Refused.

ARRESTED: Luz Maria Oquendo, W/F, DOB: 11-6-99, of 383 Zebra Drive, North Fort Myers FL.

CHARGES: Driving Under the Influence With BAC% Over .15%/Person Under 18 in Vehicle

The officer observed Oquendo in the driver’s seat upon making contact with her on the above traffic stop with Blanco Castellanos. Indicators of impairment were present and she performed poorly on field sobriety exercises resulting in her arrest. BAC%: .155 / .156

A CCPD Patrol officer observed a speeding violation at the 4000 block of Del Prado Boulevard South (58MPH in a 35MPH zone) and conducted a traffic stop. Indicators of impairment were present and Huertas performed poorly on field sobriety exercises resulting in his arrest. BAC%: .089 / .084

Indicators of impairment were present and Landry performed poorly on field sobriety exercises resulting in her arrest. She was transported to the Lee County Jail as a disorderly prisoner.
